Thank you, Kenny.? I wanted to get my ducks in a row before I mentioned due process, because I didn't know if I would be able to follow through and I am not one to make idle threats.? I can't afford an attorney, and they know it.? It is helpful to know the steps to take.
As you know it was difficult (impossible) to find someone to go with me to the meeting in December because of the short notice given by JCPS for the date.?
I can ask for another ARC meeting to be scheduled at any time.? I just feel I need to go in there with something new....like an attorney from NFB.
Thanks!
Kathryn

I have combed through all of the messages regarding this issue and of course
have talked with you (Kathryn) about your current situation. The advice I
have read mostly has been right on target. There are a few things I would
like to suggest based on this advice.
If you, or any other parent with a child with a disability is dissatisfied
with the educational services they are
receiving, you have two options. You can either enter into mediation or
file for due process. Mediation involves bringing in someone from the state
who listens to each side in order to reach compromise. Due process involves
taking legal action which will involve hiring an attorney at your own
expense. I would suggest the latter if an attorney from NFB would be
willing to take on JCPS. JCPS may back down at even the threat of due
process as has been previously mentioned. If you have another ARC meeting,
I would suggest that you either take a local parent, or have an experienced
member of the NOPBC participate via conference call as we have previously
discussed.
There should be a course of action if JCPS does not budge. The major
question I would have in your position would be whether the NFB will support
you and I would suggest you speak with Cathy Jackson to assist in obtaining
that information.
You are going to want to keep detailed records of all forms of
inappropriate educational practices Annmarie is enduring including
misspelled homework, inappropriate instructional procedures, etc. Attorneys
love to use this type of information against their opponents.
Good luck in whatever you decide to do. You know how to contact me if I may
be of assistance. You have a number of people in your corner who empathize
with your frustration.

Thank you, Kenny. I wanted to get my ducks in a row before I mentioned due process, because I didn't know if I would be able to follow through and I am not one to make idle threats. I can't afford an attorney, and they know it. It is helpful to know the steps to take.
As you know it was difficult (impossible) to find someone to go with me to the meeting in December because of the short notice given by JCPS for the date.
I can ask for another ARC meeting to be scheduled at any time. I just feel I need to go in there with something new....like an attorney from NFB.
