Yes, smoking is quite legal and is limited to certain areas to protect those
who don't care to receive the negatives from a smoker's legal right to
smoke.  Others have the right to breathe smoke free air.  When two rights
collide one has to have a place to continue exercising the right without
including those with the other right.

checked smoking was still legal.
