Please send the following out to your members and mail lists:

 

Under the Help America Vote Act (HAVA), voters have a year to file a
complaint related to accessibility.  If you, or someone you know, had
accessibility problem when voting this year you may file a complaint or
grievance.

 

Types of problems would include: 

accessible voting machines not working

election judges unable to demonstrate how to use the machines

inaccessible polling places

election judges discouraging you from voting on the voting machine 

election judges stating that the voting machines are only for voters with
disabilities (or "the handicapped")

requests for printed election information in alternate formats not met by
election officials.

 

Complaints may be filed with the county clerk and recorder or the Secretary
of State.  My preference is with the Secretary of State as that office that
has the responsibility for investigating complaints.

 

Information about the HAVA complaint process and form is available from the
Secretary of State's website:

The Legal Center would like to know about any accessibility-related problems
during the August 12 Primary election or the November 4 General Election.
This will help us in our advocacy efforts with the (new) Secretary of State,
the county clerks, the legislature and the Election Reform Commission.  

 

I am available to assist folks in filing a complaint if assistance is
desired or needed.  We have a notary in our office.  (Complaints must be
notarized.)
