The current laws can be enforced, but the courts have been chipping away
at the intent of the law by narrowly construing the law in their findings.
As such, the ADA has become a paper tiger. This legislation is an attempt
to make it enforceable again, but is overly broad.
The problem is that if the law is so broad as to fail the reasonable
person test, a reasonable person (such as a judge) is going to take one
look at a case under the newly revised ADA and say, "You've got to be
kidding!" That's usually about the time judges start finding for the
defendant and setting new precedents to make the newly revised law even
less enforceable than the old one. Wonderful.
