If he filed under the Air Carrier Access Act, the case will likely be
dismissed as several courts have held there is no private right of action.

Oops: why even file a contributory negligence as a counterclaim? that's what
happen when you write these things at 2:00 in the morning. This would
certainly amount to an affirmative defense.

Or, just move to dismiss the suit for failure to state a claim.

I chose to write to correct my error as there are many non-lawyers and law
students reading these things.
