Hi Lisa, I am not familiar with APH or the federal fund account. I am also
not a practicing attorney; I am a second-year law student. I believe that
under IDEA (the Individuals with Disabilities Education Act), a public
school may place and fund a child in a private school. However, they are not
required to do so if a free and appropriate public education (FAPE) is
available to the child. Also, a school district is not required to pay for a
child to attend a private school if the child's parent places the child
there when a FAPE is available. However, the school district may be required
to provide funding for special education services to a child who attends
private schools. IDEA requires that a school district make IDEA funds
available to disabled students, regardless of whether they attend a public
or private school.
There are likely many attorneys on this list that are much more
knowledgeable of this area than I am, so please correct me if I am wrong or
if I have missed something important. I hope this helps -- good luck.
