Yes, the sperm's his. As to your other question, I doubt the oragin of the sperm would be rellevant as a matter of Irish Constitutional law, having regard to the state's duty to guard the institution of marriage with "special care". This is speculation, there have never been any decisions on the point in this jurisdiction, though one is currently pending.
Even in the US, if they underwent the treatment together, it might be that she'd be bound by contract, I really couldn't say. On the other hand, he has no interest, having no genetic material involved in the embryos.
