DUTIES:
Attorney (Chief Attorney)
The incumbent serves as Chief Attorney in the U.S. Department of
Education,
Office for Civil Rights, (OCR) Region VI, Dallas, TX. The incumbent is
responsible for ensuring that legal aspects of the civil rights
compliance and
enforcement program support the mission of the Department and OCR's
Strategic
Plan. The incumbent sets legal sufficiency and quality standards,
reviews
work products for legal sufficiency and provides feedback on the quality
and
accuracy of work products. Works collboratively with staff within the
office,
headquarters and the Department. The Chief Attorney provides expert
legal and
policy advice to the Site Director and the Dallas office components
relating to
investigation, negotiation, resolution of complaints and compliance
reviews,
the acceptance and monitoring of corrective action agreements, and the
conduct
of enforcement actions through judicial or administrative litigation.
The
incumbent conducts legal research and analysis of state statutes and
state
agency regulations, policies and guidelines where conflicts may exit
between
state and Federal law. The incumbent must have advanced skills in legal
research and analysis. The Chief Attorney participates in all aspects
of
planning and conducting investigations, which raise extremely complex
and
difficult legal issues. Incumbent also represents the Department and
OCR in
enforcement actions.

QUALIFICATION REQUIREMENTS:

General Experience:
Interested applicants must show proof of admission to the Bar of the
highest
Court of a State, Territory, the District of Columbia, or the
Commonwealth of
Puerto Rico, and current membership in such Bar as would permit the
practice of
law; AND have relevant professional legal experience or advanced
educational
attainments which clearly indicate the ability to independently perform
complex
legal work. Applicants must possess expert knowledge of the civil
rights laws
and regulations enforced by OCR (i.e., Title VI of the Civil Rights Act
of
1964, Title IX of the Education Amendments of 1972, Section 504 of the
Rehabilitation Act of 1973, the Age Discrimination Act of 1975, Title II
of the
Americans with Disabilities Act of 1990, the Boy Scout Act, and their
implementing regulations), policy and legal issues related to enforcing
civil
rights statutes. In-depth knowledge of issues relating to sex, race,
color ,
national origin and disability discrimination in education is essential.

Qualifications for this position must be met by the closing date of this

Specialized Experience:
One year of experience must have been at a level of difficulty and
responsibility equivalent to that of an attorney at the GS-13 level.

judgement to issues arising in the context of constitutional law, and
civil
rights law. =

experience must evidence effective organization, review, coordination,
leadership and editing/oversight of their work-product to ensure quality
work
products that achieve organizational goals. =
3. Demonstrated thorough knowledge of investigative, analytical
evaluative,
dispute resolution, negotiation, and mediation techniques. =
4. Expert skills in oral communications, and experts skill in written
communications. In addition to providing a narrative statement
regarding this
factor, applicants must submit a writing sample. =
5. Skill in establishing and maintaining effective working relationships
with
diverse individuals and groups, including state officials and high-level
government officials =
